智慧局8月25日舉辦商標法修正草案公聽會，為配合經濟產業型態變化，以及國際間對於可列為商標註冊保護的型態逐漸擴充，智慧局此次也大幅開放，修正商標法第5條，增加氣味（Scent marks）、動態（Motion marks），及全像圖（Hologrammarks）三種非傳統商標。現行商標保護的對象，以文字、圖像、記號、顏色、聲音、立體形狀，及其聯合式所組成的商標。現行商標法共94條條文，此次條文修訂38條、增訂23條、刪除8條，修正幅度達三分之二，可謂近年來修法幅度最大的一次。......【詳全文】
On August 25, the Intellectual Property Office held a public hearing to discuss a draft amendment to the Trademark Act. To accommodate the changes in the industries and follow the international trend to extend the types of registered trademark protection, the Intellectual Property Office is to amend Article 5 of the Trademark Act to include three nontraditional trademarks, namely scent marks, motion marks, and hologram marks. Under the current trademark protection, it is stipulated that a trademark may be composed of a word, figure, symbol, color, sound, three-dimensional shape, or a combination thereof. The current Trademark Act contains 94 articles. This amendment will revise 38 articles, insert 23 new articles, and delete 8 articles.
