【緣起與效益】

Artificial intelligence, Internet of Things (IoT), electric cars, big data and autonomous driving have a lot in common. They are disruptive, evolutionary, and affect all of us; they also rely on interoperability among different devices. In addition to hardware devices, software or applications also enable inter-communications, joint-collaboration, or machine learning. However, prosecuting patents for these new technologies presents new challenges. Technologies that connect all of us, learn intelligently, or drive our cars present new characteristics that must be handled differently. These challenges not only create hurdles in securing patents, but also complicate future enforcement.

人工智慧、物聯網、電動車、大數據、與自動駕駛有許多共通之處。它們都是具有破壞性的進化科技,都影響我們每個人的日常生活,並且都必須仰賴使不同裝置之間可以通訊的技術。除了硬體設備,這些新科技也必須仰賴軟體或應用程式達成互相溝通、聯合運作、或人工智慧的能力。由於它們的技術特徵,這些新的技術在取得專利的保護上面臨新的挑戰,這些挑戰不僅對於專利的取得產生障礙,也讓日後專利的訴訟與授權變得複雜許多。

Recent developments relating to joint infringement, damages, and patentability standards also empower us to better prepare for the future. These developments guide us on the patentability of these cutting-edge technologies, on determining when infringement occurs, and on availability and level of damages. Two U.S. experts in patent enforcement and strategic portfolio management will share these developments with us. Most importantly, they will analyze several patents and patent applications of several industry leaders, using them as real-world examples to discuss how to draft patent claims and specifications to address issues unique to these cutting-edge technologies.

可喜地是,在共同侵權、損害賠償、與可專利性之標準的近展,可以讓大家對未來作好準備。這些發展對於這些尖端技術的可專利性、侵權的確認、與損害賠償取得的難易度和金額都提供了新的資訊與方向。本課程特邀請兩位,對於美國專利實施和專利組合管理具有豐富經驗之專家,與各位先進分享這些發展。也會分析幾個知名企業的專利與專利申請案,藉由實際的申請案件為例,針對這些尖端技術獨有的特性,討論如何撰寫專利申請範圍與說明書。

With the development of peer-to-peer network connections, encryptions, distributed algorithms, and data storage technologies, blockchain technologies will be widely applied to numerous industries in the future. Blockchain has gone mainstream and leads various developments in related ecosystems. Businesses around the world are already integrating blockchain technologies into AIoT and big data applications, making related US patent prosecution and licensing more critical than before.

區塊鏈憑藉點對點網路設計、加密技術應用、分散式演算法、資料存儲技術等底層技術的支撐,未來必將廣泛應用在各行各業。而今(2018)年則是區塊鏈技術應用進入大眾視野、產業生態初步形成的元年,將從“紙上談兵”到“應用落地”,尤其是區塊鏈結合智慧物聯(AIoT)、大數據的高價值應用。緣此,區塊鏈相關技術之美國專利申請及授權的技巧和策略,實值吾人關切。
