1. 專利代理人規則之「工、礦業技師」

經濟部智慧財產局於日前指出，按「專利代理人規則」第三條第三款之「領有工礦業技師登記證書者」，仍限於國內「工、礦業」技師方得申請登記為專利代理人。

該局表示，有關技師之類科，依四十三年修正公佈之技師法，分為農業、工業、礦業三種，俟該法六十六年修正，不再分種類，而修正為技師分科，由行政院會同考試院定之。六十七年九月十八日發布技師分為二十科，七十八年改為土木等三十二科（詳細資料請至行政院公共工程委員會公佈欄網站查詢）。而該局認定之「工、礦業技師」，對照現行三十二科之技師而言，僅農藝科、園藝科、林業科、畜牧科、漁撈科、水產養殖科之技師非屬「工、礦業技師」。如仍有不明瞭之處，歡迎去電（02）27380007轉9012分機洽詢。

“Manufacturing & Mining Industry Technicians” under Patent Agent Regulations

The Intellectual Property Office of the MOEA recently indicated that “persons who have registration certificates as manufacturing or mining industry technicians” under Article 3, Paragraph 3 of the Patent Agent Regulations are limited to technicians of manufacturing and mining industries in Taiwan.  Only these persons may apply to be registered as patent agents.

According to the IPO, farming, manufacturing and mining were the 3 categories of technicians under the 1954 amended Technicians Law.  When the said Law was further amended in 1977, the current categorization was eliminated and the Executive Yuan, together with the Examination Yuan, would determine the classes of technicians.  20 classes of technicians were promulgated on September 18, 1978.  In 1989 the number of classes was increased to 32, including civil engineering classes (please see website of Public Construction Commission of Executive Yuan for details). Manufacturing and mining industry technicians recognized by the IPO include all of these 32 classes, except agricultural, horticultural, forestry, animal husbandry, fishery and aquacultural classes of technicians.  If there are any questions, please contact the IPO at (02) 2738-0007 ext. 9012.

2. 強化智財權保護，經濟部召開跨部會協調會

經濟部林部長義夫為繼續貫徹游院長有關加強保護智慧財產權指示事項及「推動保護智慧財產權行動年計畫」各項工作，於本(九十一)年九月二十三日召開跨部會「推動保護智慧財產權行動年計畫第三次協調會議」。

本次會議除由經濟部光碟聯合查核小組報告「加強光碟查核工作辦理情形」外，並檢視各單位推動保護智慧財產權計畫執行情形如下：

1. 加強教育宣導：

(1)  教育部請各級學校將智慧財產權相關法律列入教材、經濟部及新聞局分別運用電視、廣播、報紙、網路及電子視訊牆等宣導，並請各駐外單位蒐報國外有關我推動智慧財產權之相關輿情，對外國之不實報導適時澄清。

(2)  於今年十一月九日假中正紀念堂廣場舉辦「推動保護智慧財產權行動年戶外大型宣導活動」，以展示推動保護智慧財產權行動年之成果並表揚政府機關、公民營企業保護智慧財產權優良單位。

2. 落實政府機關使用合法軟體：

行政院主計處已分別於台北、高雄及台中辦理政府機關電腦軟體管理研討會，向三百餘位政府機關電腦軟體管理人員介紹軟體管理工具及軟體管理實務。

3. 加強光碟工廠查核，有效打擊不肖仿冒：

(1)  經濟部光碟聯合查核小組自九月二日起與警政署合署辦公，將採主動積極出擊之查核策略，不定時及夜間查核方式加強查核工作，對曾有不良紀錄或有從事盜版行為之虞的光碟製造工廠，列為重點查核對象，期能從源頭杜絕盜版光碟。

(2)  查緝仿冒成果：法務部高檢署指揮檢警調單位，自今年一月三十日起截至八月三十一日止，共查獲仿冒盜版案件三、一二六件，移送二、七五七人，查獲物品市價約值新台幣七十五億八千三百多萬元；光碟聯合查核小組自今年一月至九月二十三日止，共查核一三０家次光碟製造工廠，配合檢警相關單位破獲重大盜版光碟案件計六件，依光碟管理條例查扣製造機具、模具等及違法光碟片十八萬餘片；財政部關稅總局及所屬海關在邊境管制上亦查獲出口仿冒歐米茄手錶、進口仿冒小熊維尼填充玩具及愛迪達電子錶案件。

為有效落實智慧財產權各項措施，經濟部將在本年十二月繼續召開跨部會協調會報，檢討上述措施執行成果及規劃未來推動方向。

MOEA Calls Cross-Departmental Meeting for IP Protection

On September 23, 2002 the Minister of Economic Affairs, Mr. Lin Yi-fu, called a cross-departmental “3^rd Coordination Meeting for the Protection of Intellectual Property Rights Action Year Plan”.  The purpose of the meeting is to continue carrying out Premier You’s instructions relating to reinforcing protection of intellectual property rights, as well as various work scheduled for the “Protection of Intellectual Property Rights Action Year Plan”.

During the meeting the Joint Optical Disks Enforcement Taskforce (JODE) of the MOEA gave a report on its progress in reinforcing investigations concerning optical media.  In addition, progress made by other departments is reviewed:

1.    Reinforcing public education:

(1) The Ministry of Education requests that schools at all levels include laws relating to IPRs in their teaching materials, while the MOEA and the Government Information Office will each promote IPR concepts through television, radio, Internet and video wall broadcasts, as well as newspaper advertisements.  Departments based overseas are also requested to collect and report on foreign reports concerning Taiwan’s promotion of IPR concepts, as well as to provide clarifications in relation to false reports.

(2) On November 9 this year a major “Outdoors Function for Protection of IPR Action Year” will be held in the plaza of the Chiang Kai-Shek Memorial Hall, so as to display results from promotion of the Protection of IPR Action Year, as well as commend public and private enterprises that have achieved outstanding results in protection of IPRs.

2.    Enforce use of licensed software by government departments:

The Department of Accounts of the Executive Yuan has held computer software management seminars Taipei, Kaohsiung and Taichung, for the purpose of introducing more than 300 computer software management personnel of governmental departments to software management tools and practices.

3.    Strengthen inspections and investigations of optical media manufacturers, so as to effectively combat counterfeiting activities:

(1) Since September 2, the Joint Optical Disks Enforcement Taskforce (JODE) of the MOEA has combined administration with the National Police Administration, and more active inspection and investigation strategies will be adopted.  Random and night-time inspections will be undertaken, particularly against optical media manufacturers that have had a poor prior record or are likely to engage in pirating activities.  It is hoped that these strategies will help to stop optical media piracy from its source.(2) Results of anti-counterfeiting investigations:  police and prosecutorial departments, under the command of Procurate General’s Office of the Ministry of Justice, has uncovered 3,126 incidents of piracy during the period from January 30 to August 3 this year.  These cases involved 2,757 defendants and pirated items with a market value of approximately NT$7,583 million.  During the period from January to September 23 of this year, the JODE conducted 130 inspections on optical media manufacturers, and together with relevant police and prosecutorial departments uncovered 6 incidents of major piracy of optical media.  Pursuant to the Optical Disk  Law (ODL) the JODE confiscated manufacturing equipment, molds, and more than 180,000 disks of pirated optical media.  Border controls by the Directorate General of Customs (Ministry of Finance) and its subordinate offices have also uncovered incidents of counterfeited Omega watches for exportation, imported counterfeited Winnie the Pooh stuffed toys and Adidas watches.

The next cross-departmental coordination meeting will be held in December this year, so as to effectively enforce various measures for protection of IPRs, review results of these measures, and plan for future actions.
