Statistics on IPR Investigations by District Court Prosecutors in 1999 |
Statistics on IPR-related investigations, indictments, affirmed sentences, and converted sentences by Taiwan District Court prosecutors for 1999 are as follows: (A)Actions by Taiwan District Court Prosecutors in IPR Cases (a)District Court prosecutors received 5,047 new IPR-related cases in 1999, an increase of 672 cases from the year before. Of the new cases, 3,373 (66.83%) involved copyrights, 1,151 (22.81%) trademarks, and 523 (10.36%) patents. (b)Prosecutors concluded investigations on a total of 4,756 cases, involving 6,461 suspects, an increase of 517 cases and 253 suspects from a year earlier. Of the 6,461 suspects, indictments were handed down for 2,413 (37.35%) persons. Conviction cases were obtained against 120 (5.79%) of these indictments. (Please refer to table 1) (B)Affirmed Decisions and Sentence Conversions in IPR-related Cases (a)There were 1,937 defendants in IPR-related cases that were affirmed in 1999. No further appeals are allowed in these cases. The number was an increase of 245 persons from a year earlier. Of these 1,937 defendants, 78 persons were convicted and sentenced to at least one year. Fifty-six were sentenced to more than six months but less than one year, with 536 defendants sentenced to six months or under. A total of 60 persons were sentenced to detention, while 32 were fined. Of the total number of those convicted in 1999, 39.34% received jail terms, detention, or fines, or an increase of 2.4% from the figure of 36.94% of a year earlier. (Please refer to table 2) (b)Decisions for a total of 470 cases involving 499 defendants were enforced. These figures are increases of 60 cases and 55 defendants from a year earlier. Of the cases in 1999, 421 cases were enforced for 448 defendants sentenced to six months or under, or detention. In these cases, defendants could apply to convert their sentences to fines. Of these cases, 417 persons (93.08%) were allowed to convert their sentences to fines, while applications for 6 persons (1.34%) were denied. (Note: For all criminal cases in the same period, 82.07% of defendants were eligible to convert sentences and only 0.15% of applications to convert sentences were denied.) (Please refer to table 3) |
